Konsepsi Subjek Hukum dan Pertanggungjawaban Pidana Artificial Intellegence

Abstract

Tulisan ini merupakan studi awal tentang subjek hukum dan pertanggungjawaban pidana kecerdasan buatan (AI). Dalam hukum Indonesia saat ini AI tidak dapat digolongkan sebagai subjek hukum ketika adanya tindak pidana yang disebabkan oleh AI atau memanfaatkan AI dalam melakukan tindak pidana. Subjek hukum yang dikenal dalam hukum pidana Indonesia saat ini termasuk dalam KUHP Baru (UU No. 1 tahun 2023) belum mengenal konsepsi AI sebagai subjek hukum dan pertanggungjawabannya. Tulisan ini mengulas tentang adanya atribusi AI dalam sejumlah tindak pidana sehingga perlu dipertimbangkan dalam hukum pidana Indonesia masa depan (ius constituendum) agar AI bisa dijadikan subjek hukum dan bisa diminta pertanggungjawaban pidananya. Di beberapa negara saat ini AI telah dijadikan subjek hukum dan dimasukkan dalam hukum nasionalnya.
