Divergent outcomes in political expression cases require scrutiny of how judges connect criminal provisions, communicative content, culpability, and evidence. This article evaluates alleged errors in convictions and the strengths and limitations of the reasons determining acquittals. It adopts doctrinal legal research, combining statutory, case, and conceptual approaches with a structured comparison of eight documents: six district court judgments and two appellate procedural determinations, involving twelve defendants in four analytical groups. The Magelang judgment inadequately distinguishes foreseeable consequences from conscious acceptance and insufficiently individualizes responsibility for violence. The Wawan judgment raises issues concerning temporal applicability and proof of knowledge of falsity. The Laras judgment has a stronger textual basis, yet its assessment of danger and the necessity of restrictions remains incomplete. The Surakarta and Delpedro acquittals provide stronger scrutiny of communicative content and individualized evidentiary links, although parts of their reasoning require correction. The Surakarta appellate determinations address only the admissibility of appeals. The article contributes an evaluative framework separating statutory interpretation, application to established facts, and evidentiary reasoning, thereby reconciling protection of political expression with accountability for proven incitement to violence.
